বাংলাদেশের রাজনীতির আকাশে নতুন করে যেন লুকোচুরি খেলা শুরু হয়েছে। শেখ হাসিনা বাংলাদেশে ফিরে আসতে দৃঢ়প্রতিজ্ঞ—প্রতিদিন তাঁর বক্তব্য এবং পারিপার্শ্বিক অবস্থা বিবেচনা করলে বিষয়টি স্পষ্ট হয়ে উঠছে। অন্যদিকে, শেখ হাসিনাকে ফিরিয়ে এনে তাঁর শাস্তি কার্যকর করতে উন্মুখ হয়ে থাকা গোষ্ঠীর বক্তব্য দিন দিন অসংলগ্ন হয়ে পড়ছে। আগে যাঁরা শেখ হাসিনাকে বাংলাদেশে ফেরাতে মরিয়া ভাব দেখাচ্ছিলেন, তাঁরাই এখন নিজেদের অবস্থান বদল করছেন।
মানুষের বাহ্যিক আচরণ এবং শারীরিক ভাষা (Body Language) পর্যবেক্ষণ করে তাঁর ভেতরের মানসিকতা বা চিন্তাভাবনা অনেকাংশেই অনুমান করা যায়। মনোবিজ্ঞানীদের মতে, একজন মানুষের মৌখিক কথার চেয়ে তাঁর শারীরিক অঙ্গভঙ্গি, চোখের ইশারা এবং কণ্ঠস্বরের ওঠানামা মনের আসল অবস্থা প্রকাশে বেশি ভূমিকা রাখে। কিন্তু যেহেতু আমরা সবাই সংশ্লিষ্ট বক্তাদের সামনে উপস্থিত হয়ে তাঁদের শারীরিক ভাষা পর্যবেক্ষণ করতে পারছি না (বাস্তবে যা প্রায় অসম্ভব), তাই আমাদের তাঁদের মৌখিক বক্তব্য বা সিদ্ধান্তের ওপর ভিত্তি করেই অবস্থান বিচারের চেষ্টা করতে হবে। অতিরিক্ত মানসিক চাপ বা উদ্বেগ (Stress & Anxiety) মানুষের সিদ্ধান্ত দ্রুত পরিবর্তন করে এবং কোনো একটি নির্দিষ্ট সিদ্ধান্তে স্থির থাকতে দেয় না।
বাংলাদেশের আইসিটি (ICT)-এর চিফ প্রসিকিউটর দুদিন আগে যা বললেন তার অর্থ দাঁড়ায়—শেখ হাসিনার দেশে ফেরায় কোনো আইনগত সমস্যা নেই। অথচ তার ঠিক একদিন পরেই আবার বললেন, বাংলাদেশ ও ভারতের মধ্যে আলোচনা করে শেখ হাসিনাকে দেশে ফেরাতে হবে, হুট করে আসা ঠিক হবে না। এমন পরিস্থিতি আমরা এর আগেও দেখেছি—১৭ মে ১৯৮১ সালে এবং ৭ মে ২০০৭ সালে শেখ হাসিনার দেশে ফেরা নিয়ে। উল্লিখিত দুই বারই তাঁকে দেশে ফিরতে বাধা দেওয়া হয়েছিল, কিন্তু সব বাধা উপেক্ষা করে শেখ হাসিনা দেশে ফিরেছেন। শুধু তাই নয়, ১৯৮১ সালে অনেকটা জোর করেই দেশে ফেরার পর ২০২৪ সালের ৫ আগস্ট পর্যন্ত অন্তত ১৯ বার শেখ হাসিনাকে হত্যার চেষ্টা করা হয়েছে, কিন্তু কোনো কিছুতেই তিনি দমে যাননি।
বর্তমান অন্তর্বর্তীকালীন সরকার যখন বুঝতে পেরেছে যে শেখ হাসিনা ফিরবেনই, তখন তারা নানা আইনি বাহানা শুরু করেছে। বলা হচ্ছে, ভারত ও বাংলাদেশের মধ্যে যে প্রত্যর্পণ বা বন্দিবিনিময় চুক্তি আছে, সেই চুক্তির আওতায় ভারত শেখ হাসিনাকে বাংলাদেশে পাঠাতে বাধ্য। আসুন, এই চুক্তির কয়েকটি ধারা নিয়ে একটু আলোচনা করা যাক এবং দেখা যাক কীভাবে তা শেখ হাসিনার ক্ষেত্রে প্রযোজ্য হতে পারে।
ভারত ও বাংলাদেশের মধ্যে ২০১৩ সালে একটি প্রত্যর্পণ চুক্তি স্বাক্ষরিত হয়, যা ২০১৬ সালে সংশোধিত হয়। পলাতক আসামিদের দ্রুত হস্তান্তরের জন্য এই চুক্তিটি করা হয়েছিল। এখানে প্রশ্ন উঠেছে—শেখ হাসিনা কি আসলেই পলাতক? নাকি ৫ আগস্ট ২০২৪ সালে বাংলাদেশের তৎকালীন পরিস্থিতিতে বাংলাদেশের বিমানবাহিনী তাঁকে ভারতে রেখে এসেছে? তাঁর কাছে তখনো কূটনৈতিক পাসপোর্ট ছিল এবং তিনি সেই সময়েও বাংলাদেশের বৈধ প্রধানমন্ত্রী ছিলেন (যদিও পরে ২০২৪ সালের ৮ই আগস্টের পর তা বাতিল করা হয়)। এ কারণেই ভারত শেখ হাসিনাকে তাঁদের দেশে 'অতিথি' মর্যাদায় স্থান দেয়, যা ছিল সে দেশের একটি সর্বদলীয় সিদ্ধান্ত।
চুক্তির আরেকটি গুরুত্বপূর্ণ ধারা হচ্ছে—দ্বৈত অপরাধ (Dual Criminality)। যে অপরাধের জন্য বন্দিকে চাওয়া হচ্ছে বা হবে, তা অবশ্যই উভয় দেশের আইনেই শাস্তিযোগ্য অপরাধ হতে পারে বা হবে। সাধারণত, যে অপরাধের শাস্তি কমপক্ষে এক বছর কারাদণ্ড, কেবল সেসব ক্ষেত্রেই এই চুক্তি কার্যকর হয়। এখন কথা হলো, আইসিটি (International Crimes Tribunal) কোর্ট তো ভারতে নেই। তাহলে বাংলাদেশ সরকারকে শেখ হাসিনার বিরুদ্ধে আনীত অভিযোগ ও তাঁকে শাস্তি প্রদানের প্রক্রিয়াটির বিস্তারিত জানিয়ে ভারতের কাছে প্রমাণ করতে হবে যে, তিনি (শেখ হাসিনা) মানবতাবিরোধী অপরাধ করেছেন; তবেই এই ধারা কার্যকর করা সম্ভব।
চুক্তির নিয়ম অনুযায়ী, কোনো আসামিকে হস্তান্তরের পর যদি তাঁর মৃত্যুদণ্ড কার্যকর হওয়ার আশঙ্কা থাকে, তবে অনুরোধকারী দেশকে (এক্ষেত্রে বাংলাদেশ) লিখিত নিশ্চয়তা দিতে হবে। এই নিশ্চয়তায় উল্লেখ থাকতে হবে যে, আসামিকে মৃত্যুদণ্ড দেওয়া হবে না, আর যদি দেওয়াও হয় তবে তা কার্যকর করা হবে না (তার পরিবর্তে যাবজ্জীবন বা অন্য কোনো সাজা দেওয়া হবে)। বাংলাদেশ কি ভারতকে এমন কোনো লিখিত নিশ্চয়তা দিয়েছে? তার আগে তো বাংলাদেশকে সাক্ষি সাবুদ দিয়ে ভারতের কাছে প্রমাণ করতে হবে যে, শেখ হাসিনা মৃত্যুদণ্ডের মতো সাজা পাওয়ার মতো অপরাধ করেছেন।
চুক্তিতে অনুরোধ প্রত্যাখ্যানের সুযোগও রয়েছে। এতে বলা হয়েছে, যদি অনুরোধকারী দেশ এমন কোনো আইনি নিশ্চয়তা দিতে ব্যর্থ হয় বা অস্বীকার করে, তবে আশ্রয় প্রদানকারী দেশ (এ ক্ষেত্রে ভারত) ওই আসামিকে হস্তান্তর করতে আইনগতভাবে অস্বীকৃতি জানাতে পারে।
আরেকটি বাস্তবসম্মত প্রশ্ন হলো, শেখ হাসিনা এখন ভারতে আছেন ভ্যালিড পাসপোর্ট ছাড়া। তাহলে এখন কী হবে? তাঁকে কি ট্রাভেল পাস দেওয়া হবে, নাকি হবে না? অভিজ্ঞ মহল বলছেন, ট্রাভেল পাস না দিলেও শেখ হাসিনা দেশে ফিরবেন, কারণ তিনি এই মা ও মাটির সন্তান।
বাংলাদেশের আইসিটি-এর চিফ প্রসিকিউটর যে আইনের ওপর ভিত্তি করে শেখ হাসিনাকে বাংলাদেশে ফেরত চাচ্ছেন, সেই আইনের জ্ঞান যদি এমন নড়বড়ে হয়, তাহলে তাঁরা শুধু শেখ হাসিনা কেন, গোটা বাংলাদেশকে যে ফাঁসি দিয়ে পূর্ব পাকিস্তান বানিয়ে দেননি, সেটাই আমাদের সৌভাগ্য!

A new political game of hide-and-seek appears to have begun in Bangladesh. Sheikh Hasina seems firmly determined to return to the country, a conclusion that becomes increasingly evident from her recent statements and the surrounding political developments. Meanwhile, the arguments of those eager to bring her back in order to enforce punishment against her are becoming increasingly inconsistent. Those who once appeared determined to ensure her return are now gradually changing their positions.
A person's external behavior and body language often reveal much about their inner thoughts and mental state. According to psychologists, body movements, eye contact, and vocal expressions frequently communicate more than spoken words. However, since we cannot directly observe the body language of the individuals concerned, we must rely on their public statements and decisions to assess their positions. Psychology also suggests that excessive stress and anxiety often lead people to change their decisions rapidly and make it difficult for them to remain consistent.
Two days ago, Bangladesh's ICT Chief Prosecutor stated that there was no legal obstacle preventing Sheikh Hasina from returning to Bangladesh. Yet only a day later, he said that Bangladesh and India would first need to hold discussions before her return, adding that she should not come abruptly. Similar situations have occurred before—during Sheikh Hasina's returns on May 17, 1981, and May 7, 2007. On both occasions, attempts were made to prevent her return, yet she came back despite all obstacles. Furthermore, after her return in 1981, there were at least 19 reported attempts on her life up to August 5, 2024, but none succeeded in deterring her.
As the current interim government appears to have realized that Sheikh Hasina intends to return, it has begun raising various legal arguments. It is being claimed that under the extradition treaty between Bangladesh and India, India is obliged to send Sheikh Hasina back to Bangladesh. Let us briefly examine some of the treaty's provisions and consider how they may apply in her case.
Bangladesh and India signed an extradition treaty in 2013, which was amended in 2016 to facilitate the speedy transfer of fugitive offenders. This raises an important question: Is Sheikh Hasina legally a fugitive, or was she taken to India by the Bangladesh Air Force during the circumstances of August 5, 2024? At that time, she still possessed a diplomatic passport and remained the lawful Prime Minister of Bangladesh, although her passport was later revoked after August 8, 2024. It is argued that this is why India granted her guest status, reportedly as part of a bipartisan national decision.
Another important principle of the treaty is Dual Criminality. The offense for which extradition is sought must be punishable under the laws of both countries. Generally, the offense must carry a minimum sentence of one year's imprisonment. The question therefore arises: since India's legal system does not have an International Crimes Tribunal equivalent to Bangladesh's ICT, Bangladesh would need to demonstrate to India the nature of the allegations, the legal process, and the basis for claiming that Sheikh Hasina committed crimes against humanity before this provision could be invoked.
Under the treaty, if an extradited individual could face the death penalty, the requesting state—in this case Bangladesh—must provide written assurances that the death sentence will either not be imposed or, if imposed, will not be carried out and will instead be commuted to life imprisonment or another punishment. Has Bangladesh provided India with such written assurances? Before doing so, Bangladesh would also need to present sufficient evidence demonstrating that Sheikh Hasina committed offenses warranting such a sentence.
The treaty also provides grounds for refusing an extradition request. If the requesting country fails or refuses to provide the required legal assurances, the requested country—in this case India—may lawfully decline to surrender the individual.
Another practical question is that Sheikh Hasina is currently in India without a valid passport. What happens in such circumstances? Will she be issued a travel document or not? According to some observers, even without a travel pass, Sheikh Hasina would still return because, as they put it, she is a daughter of her motherland.
If the Chief Prosecutor of Bangladesh's ICT possesses such an uncertain understanding of the very law under which he seeks Sheikh Hasina's return, then it is perhaps fortunate, the author argues, that they have not metaphorically sentenced the entire nation and turned Bangladesh back into East Pakistan.
Sheikh Hasina, reportedly a student of Bengali literature, is said to have written:
